By accessing our website, submitting a placement request, entering into a service agreement, or purchasing products from any Snak Group vending machine, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you are entering into an agreement on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, do not use our website or services.
2. Services Overview
Snak Group provides smart vending machine services to businesses, offices, apartment complexes, gyms, medical facilities, and other commercial locations throughout the Greater Houston area. Our services include:
- Machine placement at zero cost — we supply, deliver, and install smart vending machines at qualifying locations at no charge to the location partner
- Product stocking — we stock machines with a curated selection of snacks, beverages, fresh food, and other products tailored to each location's preferences and demand
- Regular restocking — we monitor inventory levels through real-time smart technology and restock machines on a scheduled basis, typically weekly or as needed based on sales volume
- Maintenance and repairs — all routine maintenance, cleaning, and repairs are performed by Snak Group at no cost to the location partner
- Data-driven optimization — we use transaction data and analytics to continuously improve product selection and ensure machines are stocked with high-demand items
- Revenue sharing — qualifying location partners may participate in our revenue share program, details of which are outlined in the individual service agreement
3. Machine Placement and Location Requirements
Machine placement is subject to a site evaluation by Snak Group. We assess factors including foot traffic, location accessibility, available space, electrical access, and estimated demand to determine eligibility. Not all locations will qualify for placement.
If your location is approved, Snak Group will:
- Provide and install the machine at no cost to you
- Handle all logistics related to delivery, setup, and configuration
- Maintain ownership of the machine at all times — machines are the property of Snak Group and are not sold, leased, or transferred to the location partner
The location partner agrees to:
- Provide a suitable location with a standard electrical outlet (110V) and adequate space for the machine
- Allow Snak Group personnel reasonable access to the machine for restocking, maintenance, and servicing
- Not tamper with, modify, relocate, or attempt to repair the machine without prior written consent from Snak Group
- Notify Snak Group promptly of any damage, malfunction, or issue with the machine
4. Payments and Pricing
4.1 Consumer Purchases
All prices displayed on the vending machine at the time of purchase are final. Prices may vary by product and location and are subject to change without notice. Applicable sales tax is included in or added to the displayed price in accordance with Texas state and local tax requirements.
4.2 Payment Methods
Our smart vending machines accept the following cashless payment methods:
- Credit cards (Visa, Mastercard, American Express, Discover)
- Debit cards
- Apple Pay
- Google Pay
- Other NFC-enabled contactless payment methods
Some machines may also accept cash. Payment method availability may vary by machine model and location. All electronic payments are processed through PCI-DSS compliant third-party payment processors.
4.3 Refunds
If a product is not dispensed after payment or if a dispensed product is defective (e.g., expired, damaged, or incorrect item), please contact us at (682) 255-1033 or snakgroupteam@snakgroup.biz with the machine location and approximate time of the transaction. We will investigate the issue and provide a refund or replacement as appropriate.
5. Product Information
We make reasonable efforts to ensure that products stocked in our machines are fresh, properly stored, and within their expiration dates. However:
- Product availability is not guaranteed and may vary based on supply, demand, and restocking schedules
- Nutritional information, ingredient lists, and allergen warnings are provided on individual product packaging by the product manufacturer — Snak Group is not responsible for the accuracy of manufacturer-provided labeling
- Consumers with food allergies or dietary restrictions should review product labels carefully before purchase
6. Limitation of Liability
To the maximum extent permitted by applicable law:
- Snak Group provides its services and products on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Snak Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our services, website, or products, including but not limited to loss of profits, data, or business opportunities
- Snak Group's total aggregate liability for any claims arising from these Terms or our services shall not exceed the amount you paid for the specific product or transaction giving rise to the claim
- Snak Group is not liable for damages to the location partner's property caused by power surges, natural disasters, vandalism, or other events beyond our reasonable control
7. Indemnification
You agree to indemnify, defend, and hold harmless Snak Group, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your violation of these Terms, your misuse of the services, or any third-party claims related to your use of a Snak Group vending machine at your location.
8. Intellectual Property
All content on the Snak Group website — including but not limited to text, graphics, logos, images, videos, page layouts, and software — is the property of Snak Group or its licensors and is protected by United States copyright, trademark, and other intellectual property laws.
The Snak Group name, logo, and all related brand elements are trademarks of Snak Group. You may not use, reproduce, modify, or distribute any of our trademarks or copyrighted content without our prior written consent.
The design, software, and technology embedded in our smart vending machines are proprietary to Snak Group and our technology partners. Location partners and end users are prohibited from reverse-engineering, copying, or interfering with the machine's hardware or software systems.
9. Termination
9.1 Termination by Location Partner
Location partners may request removal of a Snak Group vending machine by providing written notice at least 30 days in advance. Upon receiving a termination request, Snak Group will schedule removal of the machine at a mutually agreeable time. Any outstanding revenue share payments owed to the location partner will be settled within 30 days of machine removal.
9.2 Termination by Snak Group
Snak Group reserves the right to remove a machine from any location at any time for any reason, including but not limited to:
- Insufficient sales volume to justify continued service at the location
- Breach of these Terms or the individual service agreement by the location partner
- Repeated vandalism, theft, or damage to the machine
- Safety concerns or building code violations
- Closure or change of use of the host location
We will provide reasonable notice before removing a machine unless removal is necessitated by urgent safety or security concerns.
10. Website Use
When using the Snak Group website, you agree not to:
- Use the website for any unlawful purpose or in violation of any applicable local, state, national, or international law
- Submit false, misleading, or fraudulent information through any form on the website
- Attempt to gain unauthorized access to any portion of the website, other accounts, or any systems or networks connected to the website
- Interfere with or disrupt the operation of the website or the servers and networks used to make the website available
- Use automated tools, bots, or scrapers to access, collect, or extract data from the website without our written permission
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles. Any disputes arising from or related to these Terms or our services shall be resolved exclusively in the state or federal courts located in Harris County, Texas.
Before initiating formal legal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation. If a dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through the courts as described above.
12. Force Majeure
Snak Group shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, pandemics, acts of government, supply chain disruptions, utility failures, labor disputes, or civil unrest.
13. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
14. Changes to These Terms
We reserve the right to update or modify these Terms at any time. When we make changes, we will revise the "Last updated" date at the top of this page. Material changes may be communicated through a notice on our website or via email to location partners with active service agreements.
Your continued use of our website or services after any modifications to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should discontinue use of our website and services.
